CrucialCustom Deal Points Reminder

You have already opted-in to our CrucialCustom service, by signing our blanket “Terms & Conditions/Work-for-Hire” and “Non-Disclosure” agreements. You can review and print those anytime from your CrucialMusic account, by clicking “Artist” > “My Account” > “View or sign e-contracts or e-renewals.”

Because the CrucialCustom agreement IS DIFFERENT than the CrucialMusic agreement, we are listing the deal points below as a quick reminder.

  • You can only collaborate with co-writers who have also opted-in and signed the agreements. You can view their status in “My Account” > “Co-writers”.

  • You may not use any SAG, AFM or other union musicians or vocalists as all work delivered has to be non-union. The session may NOT be filed with any union as a union recording.

  • At the time of submission, you will be asked to provide work-for-hire agreements with any musicians, producers, or vocalists you have hired or worked with in the creation of your demo.

  • You can NOT talk to anyone about the projects on CrucialCustom unless they are a co-writer who has also opted-in to the service. If you employ singers or other musicians to create the track, you must inform them of their obligation to keep all project details confidential as they are covered under your NDA with Crucial. Posting, blogging, or sharing any project details or videos on the internet is strictly prohibited.

  • You can only submit one demo per account.

  • Crucial reviews and approves demos to be presented to the client. Crucial may request changes before presentation or reject any track for any reason.

  • Revision requests and delivery must be made within a timely manner and meet deadlines.

  • The client makes the final decision, and is not required to license any track.

  • The Crucial Client will receive one revision at no charge for a Track selected as a Top 5 Track. Additionally, if a Track is selected as the Winning Track, the Crucial Client will receive one additional free revision. Fees are charged for each additional round of revisions on the Winning Track. However, if your Track is a Winning Track, you shall receive compensation for revisions beyond the free revision(s) irrespective of whether or not the Track is actually licensed, unless you fail to timely deliver the final WAVs.

  • If your Track is the Winning Track, you shall upload the final WAV files and e-sign the Copyright Assignment within twenty-four (24) business hours of notification. Your failure to timely comply will constitute your forfeiture of all fees. Repeated non-delivery will result in removal from our service.

  • If the Winning Track is less than ninety (90) seconds in length, then you shall create a version of the Winning Track that is at least ninety (90) seconds long and a second version that is the exact time requested by the Crucial Client. Only the exact length requested needs to be uploaded as an mp3 during the submission process. Both versions of the Winning Track and Stems of the longest version must be uploaded as WAVs in the final delivery. More info available in the FAQ menu item.

  • Winning Track becomes the EXCLUSIVE OWNERSHIP of Crucial Music in perpetuity. You keep 100% of your writer's share of performance. DO NOT submit pre-existing tracks i.e…tracks you have laying around even if they are not signed. The e-signed “Copyright Assignment” is track specific, and coupled with the blanket “Terms & Conditions/Work-for-Hire” becomes a binding contract transferring ownership of the Winning Track to Crucial.

  • Winning Track receives 50% of the net receipts and 15% of all future net receipts (if client owns the track, you only receive initial fee, no future net receipts are paid).

  • If your track is in the Top 5, but not a Winning Track, Crucial may purchase the track from you for a fee, which becomes the EXCLUSIVE OWNERSHIP of Crucial Music in perpetuity. In addition, you will receive 15% of all future net receipts. You keep 100% of your writer's share of performance.

  • Any track NOT selected as the Winning Track or a Purchased Track, remains YOUR copyright and you may exploit as you wish. You can even submit to CrucialMusic.com for non-exclusive representation.

  • Crucial shall have the right to use your name and approved likeness in connection with the promotion and marketing of the Winning Track(s).

  • If your track is licensed, posting the video to your own website or social networking sites such as YouTube, Vimeo or Facebook is strictly prohibited without prior written consent from Crucial and the Crucial Client.

  • Accounting and payment will be made through your CrucialMusic account in the quarter after we receive payment.
